Purchasing Real Estate In China

If you have lived and worked in China for at least a year as a foreigner, you may want to buy real estate to secure a more permanent home or invest in commercial property for your business. Our Greater China practice lawyers can provide you with the guidance you need to successfully complete a real estate transaction.

China has specific requirements for foreigners wanting to buy property, including:

  • You must have worked or studied in China for at least a year.
  • For commercial properties, you must incorporate in China.
  • Foreigners can only own one property.
  • The property-owner must have a long-term visa.
  • You cannot act as a landlord.
  • If you are obtaining a mortgage, you must pay a 1% deposit and 30% of the purchase price to the seller in RMB.

The first step in buying property in China is to obtain proof of residency from the Municipal Bureau of Public Security. After finding a property you would like to purchase, you make an offer to the seller and negotiate the sale. You then pay 1% of the purchase price and sign an official sale contract.
